1 Appellant, Frank Daryl Hopkins, hereinafter referred to as defendant was charged with the offense of Manslaughter in the First Degree. The defendant was tried before a jury in the District Court of Pottawatomie County, and was convicted on the lesser offense of Negligent Homicide. His punishment was fixed at commitment in the county jail of Pottawatomie County for a period of one (1) year at hard labor on the county roads and payment of a fine of One Thousand Dollars ($1000.00) and costs of the action. From said judgment and sentence, a timely appeal has been perfected to this Court.
